Who these terms cover

These Terms of Service apply to Black Forest Digital and any other online game, feature, or digital service operated by Magner Labs LLC that links to these Terms. By using a covered service or completing a paid transaction for one, you agree to these Terms. If you do not agree, do not use or purchase the service.

Eligibility and accounts

You must be at least 13 years old to use the service. If you have not reached the age of legal majority where you live, a parent or guardian must approve your use. Some features may require an account, invitation, or access code. You are responsible for the accuracy of information you provide and for activity using your account or access credentials.

Free and paid features

The offer shown before checkout identifies the features included in that purchase. A purchase does not include a subscription, game review, coaching, AI allowance, another game, or any future feature unless the offer expressly says it does. We may offer separate products, subscriptions, bundles, or promotions under additional terms. If specific offer terms conflict with these Terms, the specific terms control for that offer.

Service availability and changes

Online services sometimes experience maintenance, outages, and changes. We may add, remove, or modify features and may suspend or permanently discontinue a service, including if a publisher license or another right needed to provide it ends. When reasonably practical, we will provide advance notice of a permanent discontinuation. We do not promise uninterrupted access or continued operation for any particular period.

Payments and refunds

The price, billing schedule, currency, and applicable taxes are shown before you pay. Payments may be processed through Stripe Managed Payments, with the transaction sold through Link. Link handles transaction-level support, receipts, and eligible refund requests; Magner Labs handles support for the game and access to its features.

Refunds are governed by the terms presented at checkout, Link's applicable refund policy, and any rights that cannot be limited by law. If a completed purchase is not reflected in your access, contact us so we can investigate it.

Acceptable use

You may not:

• cheat, harass other players, or disrupt games or services;
• probe, attack, overload, bypass, or interfere with security or access controls;
• copy, scrape, reverse engineer, resell, sublicense, or commercially exploit the service except where the law expressly permits it; or
• use the service for unlawful or fraudulent activity.

Intellectual property and feedback

Black Forest Digital, its software, visual design, and related content belong to Magner Labs or its licensors. Black Forest is provided under license from Feuerland Verlagsgesellschaft mbH. If you send suggestions or feedback, you give Magner Labs permission to use them without restriction or compensation, while you retain ownership of any rights you already hold in your feedback.

Suspension and termination

We may restrict or end access when reasonably necessary to protect players or the service, comply with law, enforce these Terms, or respond to fraud, abuse, or a material breach. Where appropriate, we may provide notice and an opportunity to correct the issue. Sections that by their nature should continue after termination remain in effect.

Disclaimers and limits

To the fullest extent permitted by law, the services are provided “as is” and “as available” without warranties that they will be uninterrupted or error-free. Magner Labs and its licensors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the service. Our total liability arising from a paid offering will not exceed the amount you paid for that offering during the 12 months before the claim.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded or limited.

Governing law

California law governs these Terms, without regard to conflict-of-law rules. This does not take away mandatory protections that apply to you under the law where you live.

Changes to these terms

We may update these Terms as the services change. If a change materially reduces rights associated with an existing paid offering, we will provide reasonable notice when required. The effective date shows when these Terms were last updated.
